Woman dies after assault

On 16 August 2024 a fatal incident took place in a flat on Chasséstraat in Amsterdam-West in which 37-year-old Ginelva Deira suffered a severe leg injury and died in hospital a few days later. Neighbours reported hearing sounds resembling an argument beforehand; besides the victim and the suspect, Ginelva's six-year-old daughter was also in the flat. The suspect is her boyfriend Misael L., who according to prosecutors stabbed her in an artery in her leg with a shard of glass after an outburst of rage. L. denies this and maintains that he was drowsy on the sofa and that Ginelva accidentally fell onto a glass storage jar that shattered; prosecutors find that account implausible because he waited five minutes before calling emergency services and gave inconsistent statements. In the summer of 2026 the case was heard on its merits at the Amsterdam district court. Prosecutors demanded eight years in prison for manslaughter and explicitly described the case as femicide. L., by then two years in pre-trial detention, stuck to his account in court. The court gave judgment on 10 September 2026 and did not follow the prosecution. It acquitted L. of manslaughter: it did not find that he had intended her death, only conditional intent to cause grievous bodily harm, since driving a sharp object deep into the upper thigh close to the groin carries, by ordinary experience, a substantial chance of arterial bleeding. He was convicted of aggravated assault resulting in death, and in a second case of trespass and resisting arrest. The court imposed five years - three less than demanded - plus a behavioural and liberty-restricting order allowing long-term supervision after his release. Compensation was awarded to the relatives, including sums to be placed in protected accounts for the children.
