Ismail Zahi (26) shot dead on Transvaalkade after an exchange of fire

Samir O. and 26-year-old Ismail Zahi had been at odds for years. On Saturday 15 June 2013 they ran into each other on the Transvaalkade in Amsterdam-Oost. Zahi drew a firearm first and fired first. O. was also armed and fired back; Zahi was fatally hit. Prosecutors demanded six years, arguing that O. could have run: once the roles were reversed he had chased the victim with a revolver in his hand and fired several shots, one of which struck Zahi in the back. On the prosecution's reading, witness statements showed that O. had fired deliberately rather than in panic, and that his shock set in only after the shooting. On 17 February 2014 the Amsterdam court acquitted him. Prosecutors appealed and again demanded six years, but on 1 February 2016 the Amsterdam court of appeal held that his plea of excessive self-defence succeeded: O. was not criminally liable for the fatal shooting. He was sentenced to four months for possession of the firearm.
